Booking Terms & Conditions for Tour and Travel

When you book a Tour with Australian Iconic Tours, we want you to be totally satisfied with the arrangements so that you will book with us again in the future. To avoid misunderstandings, you should be in no doubt as to the commitments we have to you and, in turn, the obligations you have to us. Listed below are several important points which we would like you to read carefully. None of the terms or conditions are intended to contravene or contradict with The Australian Consumer Law.

The below Booking Conditions set out the terms for a contract between you and Australian Iconic Tours. By making a booking and making any payments to us, you acknowledge that you have read, understood, and agree to be bound by these Booking Conditions.

All tours require a deposit of $495 per person with the final balance due 4 months prior departure. Private tours and charters may have different payments terms and conditions. Please refer to your group’s contract/invoice.

 

General 

If you wish to cancel your tour, for whatever reason, you must let us know as soon as possible. This can be done on the phone or in writing. Cancellation will be effective at the time notification is received and confirmed by Australian Iconic Tours.

If You Cancel Your Tour 

If you cancel your tour for any reason we will be forced to apply our cancellation charges at the following rates:

Full Refund = Cancellation made 101 days or more prior tour departures

50% Refund = Cancellation made within 100 – 76 days prior tour departures

No Refund = Cancellation made within 75 days prior tour departures

  • Extended Private Tours and Charters

*Some extended private tours and charters may have a different cancellation policy due to supplier’s terms and conditions. Please refer to your group’s contract / tax invoice.

If you have made a payment by credit card, we incur bank charges which cannot be recovered. Credit card fees are non- refundable.

If Australian Iconic Tours can resell your seat, the amount refundable is what your tour ticket was sold for (example last minute sale price to fill your spot). We may have other people on the waiting list to join your tour.

Australian Iconic Tours recommends to our passengers to have comprehensive travel insurance.

Comprehensive travel insurance can cover the loss or damage to your personal items, illness, or injury while on tour or short notice cancellation on your part. Australian Iconic Tours has no affiliation with any travel insurances and cannot give any advice on which insurance company to use or how to make a claim. You must deal directly with your Insurance Company. A Cancellation Confirmation is provided.

Requests for changing the booking to another departure date within the Full Refund Terms will incur no amendment fee.

Requests for changing the booking to another departure date within the No Refund Terms will be treated as a cancellation.

Booking Transfer to another person

If, after booking your tour, you are prevented from travelling and wish to transfer the booking to another person (family member or friend), Australian Iconic Tours will agree if the other person satisfies all the conditions applicable to the package, and subject to both persons accepting joint and several liabilities for full payment of the package price.

Single Rooms

If any person with whom you are sharing a room should cancel within the full refund terms, any additional charges such as a single supplement are applicable and payable by you.

 

If We Change or Cancel Your Tour 

If we cancel your tour for reasons other than Force Majeure (see below) , you will be offered a refund of the tour cost (except credit card surcharges) received by us, or at your selection a transfer to an alternative tour.

To the fullest extent permitted by law, we will not be responsible for any other loss or costs you incur (for example, airfares and hotel costs not included in your tour package, insurance, and visa expenses) if your tour is cancelled for any reason.

 

Due to the dynamic nature of the travel industry, it could become necessary, in certain circumstances beyond our reasonable control, to change your tour arrangements, to amend itineraries, change accommodation, restaurants, vehicles, planes or vessels and tour inclusions prior travel and you acknowledge our right to do this. We will endeavour for these substitutes to be of a substantially comparable standard. We will endeavour to minimise substitutions.

Tour components are prepared months in advance; however, we may need to alter the route or itinerary during your tour due to local circumstances, including but not limited to road conditions and closures, poor weather, changes in transport schedules, cultural considerations and/or vehicle breakdowns. In these circumstances we will endeavour to make suitable alternative arrangements.

We can give no guarantee of the exact arrival and departure times for carriers and operators used by us, and we will not be liable for failure to make connections with other services or attractions. No refund will be given in these circumstances.

 

Fuel Levy – All tours are subject to an additional levy for coach/flight/air components that may be imposed and is out of Australian Iconic Tours control.

Seat Allocation – To ensure the enjoyment of all passengers, and to enable you to get to know your fellow travellers, we operate a daily seat rotation system in which all passengers must participate. Your guide may point out which seat is allocated to you on any day to ensure seat rotation.

Dietary Requirements – Any special dietary requirements need to be received at least 6 weeks before departure. We will endeavour to communicate your requirements to all relevant suppliers. However, we cannot guarantee requests will be met by suppliers. It is your responsibility to check that meals and beverages do not contain any allergens. We expressly disclaim any liability for meals or beverages that contain allergens other than in circumstances where we have been negligent.

Image Release – We and our suppliers may take photographs or make recordings of you and your activities that identify you during your tour. We reserve the right to use any images and/or recordings for promotional and marketing purposes. You consent to this use and acknowledge you will not be entitled to any payment or other compensation. If you do not consent to the use of your image or likeness, please advise us as least 21 days prior to the commencement of your tour.

Luggage

Your luggage allowance is limited to one Medium size suitcase or soft bag weighing no more than 15 kg (or the weight limits specified below, in relation to specific tours). Your luggage’s width, length and depth must not exceed 140cm with wheels. You may also take onboard touring vehicles one hand-luggage item to be stored in the overhead luggage racks or in front of you if racks are not present. Hand luggage must not exceed 10 kg per person and is a bag which you carry around during our daily activities, each time we disembark the vehicle.

Some tours have different luggage restrictions:

3 Day and 4 Day Small Group (max 5x passengers) 4WD Tours: Luggage not to exceed a Cabin size bag with 10kg.

1-2 Day Overnight Flying Expeditions: AIT overnight bag is supplied and must be used, not exceeding 5kg.

Luggage limits are enforced. You will be required to leave any excess luggage at the point of embarkation for the duration of the tour, which will be stored at your risk and cost. You will be responsible for any shipping to the point of disembarkment or such other address as you notify.

You must not bring onboard any goods or objects of a flammable or dangerous nature or which we reasonably consider could harm or significantly detract from the enjoyment of other guest including: (i) firearms, knives, weapons or sharp objects; (ii) alcohol for consumption onboard or illegal drugs of any kind; (iii) items that may become or are dangerous, such as seal batteries, explosives, poisons (such as pesticides and herbicides); (iii) items prohibited by law; (iv) drones or (v) animals (with the exception of guide / assistance dogs. You must advise us prior to booking if you wish to be accompanied by a guide / assistance dog. It may not always be possible to accommodate guide / assistance dogs due to the fact that, amongst of things, many tours traverse remote and native title areas, vehicles may be confined, other passengers may have allergies and third-party consents may be required.

 

On Tour – Our products include and depend on the services provided by our suppliers such as hoteliers, airlines, coach companies and other third-party operators who are not agents, servants, or employees of Australian Iconic Tours. Although we take care in selecting the suppliers and optional tour excursions, we cannot and do not take responsibility for the conduct of our suppliers, their servants, agents, or sub-contractors. Australian Iconic Tours has a Passenger Code of Conduct. Australian Iconic Tours representatives/crew or any carrier reserves the right at its discretion to exclude from a tour, or to terminate the travel arrangements of, any person who is in breach of our Passenger Code of Conduct or who:

  • is incapable of caring for themselves, or is suffering any mental or physical impairment and/or infectious illness;
  • is unable to cope with the requirements of the tour or who may require services or facilities that are not available;
  • fails to comply with the reasonable instructions of crew employed by Australian Iconic Tours or its suppliers;
  • engages in illegal or undesirable behavior or interferes with the enjoyment of or jeopardises the safety of other participants;
  • is a hazard to themselves or other passengers; and/or
  • is likely to become objectionable to other passengers, Australian Iconic Tour crew and or third-party Suppliers.

Anyone so excluded will be required to disembark the tour at a safe public location and arrange their own transportation at their cost. If you are excluded, you will not be entitled to any refund or credit voucher for your tour package price.

You agree that Australian Iconic Tours is released from all liability for, and you agree not to hold Australian Iconic Tours responsible for a termination of your travel made by Australian Iconic Tours or by any service provider who refuses to provide service to you for any reason including, but not limited to, due to the unavailability of special accommodation facilities or services or if a crew member refuses to carry you by reason of any disability or medical condition or undesirable behaviour.

You understand and acknowledge the dangers associated with the consumption of alcohol and or any mind-altering substances before or during any activity, and you accept full responsibility for injury, loss or damage associated with the consumption of alcohol or any mind-altering substances.

 

Health & Fitness

Australian Iconic Tours has the well-being of all travellers in mind. If you are unwell before joining the tour or on the morning of departure, it is your obligation to disclose any pre-existing or new medical or other condition that may affect the risk that either you or any other person will suffer injury, loss, or damage.

You acknowledge that Australian Iconic Tours relies on information provided by you, and that all such information is accurate and complete.

Several tours take us on dirt road tracks to remote locations and emergency assistance may take several hours to arrive. If you are unwell, travelling can make an illness or condition worse.

If you suffer any injury or illness while on tour, Australian Iconic Tours may provide evacuation, first aid and medical treatment at your expense. Should an accident or incident occur, Australian Iconic Tour crew may use a defibrillator if available in the event of a major medical emergency to which clothing may need to be removed.

By joining our tour, you accept these terms and conditions and consent to such evacuation, first aid and/or medical treatment. This may include attendance or evacuation by the Royal Flying Doctor Service or a similar service. You agree to reimburse us for any costs we incur in seeking medical treatment on your behalf.

Some walking tracks have steep uphill sections, are uneven, on sandy or rocky ground and may be slippery. Temperatures may be extreme. Our (or our supplier’s) crew may refuse to take you on a particular activity (not limited to walks) if you are unable to meet the required fitness level on the day. No refund will be given in these circumstances and if this results in any additional charges, we reserve the right to pass on these charges to you.

You are required to have a reasonable level of mobility and to be able to board and alight vehicles unaided by our crew. Due to space restrictions onboard our touring vessels, we are unable to accommodate wheelchairs or walkers.

Our crew will be pleased to provide general assistance throughout your tour. However, our crew and your fellow passengers are unable to meet the needs of guests requiring regular medical attention and are not able to act as carers. If you require special assistance, you must be accompanied by a person who is able to provide such assistance.

If you have doubts about your ability to undertake the tour or components of the tour, please contact us to discuss your circumstances prior to making a booking.

 

Limitation of Liability

Risk Acceptances & Waivers

You acknowledge that your tour and its components may expose you to inherent personal risks which may be greater than those present in your everyday life. This could be because of the adventurous nature of the tour, travelling through and visiting remote destinations, and interactions with wildlife. You travel on the basis that you accept these inherent risks and that to the fullest extent permitted by law we will not be responsible for any personal injury or death, loss or damage resulting from the materialisation of an inherent risk.

You acknowledge and agree that your participation in certain activities may be subject to you agreeing to a form of risk acceptance and waiver of liability for participation in the activity. Independent Suppliers and Additional Services Principals may also require you to agree to such forms.

Where an Independent Supplier is the supplier of tour services, you acknowledge that our obligations to you are limited to taking reasonable care to select a reputable Independent Supplier and arranging for them to provide those tour services to you. Independent Suppliers over whom we may not have direct control could include hoteliers, independent transport companies (i.e., vehicles not operated by us), excursion operators, venue operators and common carriers.

To the fullest extent permitted by law, we will not be responsible to you for any loss, damage, personal injury or delay attributable to the actions, omissions or negligence of an Independent Supplier and not caused by our negligence. Any claims you have in this regard must be made against the Independent Supplier.

All accidents, injuries, loss, or damage must be reported by you to Australian Iconic Tours before you leave Australian Iconic Tours’ property or tour conclusion.

 

Force Majeure Event

A Force Majeure Event means any event or circumstance beyond the control of Australian Iconic Tours, including but not limited to acts of god (such as earthquake, flood, fire, cyclone, storm or natural disaster), industrial disputes (including work ban/labour disputes), acts of terrorism, political unrest, war or threat of war, riots or civil strife, failure or delays to scheduled transportation, the closure of airports or ports, criminal acts committed by third parties, pandemic, epidemic or health risk or governmental directions (including lockdowns, quarantine requirements, border closures and travel warnings and restrictions).

For the avoidance of doubt and without limitation, an illness, the development of a medical condition or the failure of any commercial transportation not included in your tour is not considered a Force Majeure event.

Limitation of Liability in the Event of Force Majeure

If Australian Iconic Tours, in its reasonable opinion, considers that any Force Majeure event prevents us (whether directly or indirectly through its suppliers, employees, contractors, sub-contractors and agents) from providing any products and/or tours services to you

(whether lawfully or otherwise), We may at any time by written notice to you:

(a) cancel your booking and provide you with a refund of recovered third-party costs plus any third-party costs we don’t incur for the cancelled tour services or

(b) amend your booking as we think fit, acting reasonably, which may include changing your travel arrangements to an alternative tour with the view of safeguarding your interest and safety.

> During Tours

If we cancel tour services due to Force Majeure during your tour, we will provide you with a refund of recovered third-party costs plus any third-party costs we don’t incur for the cancelled tour services.

> General

If we provide you with any alternative tour or assistance where tour services are cancelled due to Force Majeure which you accept, then you agree that any amount to be refunded to you will be reduced by the value of these services and that assistance.

To the fullest extent permitted by law, our liability to you for cancellations due to Force Majeure is limited to your rights under this clause.

 

Privacy Policy

Australian Iconic Tours is committed to protecting your privacy.

Personal Details

To process your booking and to ensure that your travel arrangements run smoothly and meet your requirements we need to use the information you provide such as name, address, any special needs/dietary requirements etc.

We take full responsibility for ensuring that proper security measures are in place to protect your information.

Use of Your Information

We must pass the information on to the relevant suppliers of our travel arrangements such as hotels and scenic flight companies etc. We will not however, pass any information on to any person not responsible for part of our travel arrangements. This applies to any sensitive information that you give us such as details of any disabilities, or dietary/religious requirements.

Direct Marketing

We may from time to time contact you by post, email, or telephone with information about our holidays, including new products, travel club offers and forthcoming events. If you do not wish to receive such information from us, please notify us and we will endeavour to discontinue direct mail/email to you.

Links from Other Websites

Other websites may collect data and personal information. We (Australian Iconic Tours) are not responsible for the actions, content or privacy policies of those websites linking to our website.

 

 

We may vary any provision of these Terms and Conditions or our policies at any time by uploading the revised Terms and Conditions and/or policies on our website.
